Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and WIENER (“WIENER”, “we”, “us”, or “our”) and govern your use of the WIENER mobile application and our website at wiener.wtf (together, the “Service”). WIENER is an online party-games app where you play games with friends over group voice chat. By joining our waitlist, creating an account, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or guardian. By using the Service, you represent that you meet these requirements, have the legal capacity to enter into these Terms, and are not barred from using the Service under applicable law.
2. Your Account
You agree to provide accurate information when you join the waitlist or create an account, and to keep it up to date. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please notify us promptly at hello@wiener.wtf if you believe your account has been accessed without your permission.
3. Friends and Groups
WIENER lets you connect with friends and play together in groups and game rooms. When you join a room or accept an invite, other players in that room may see information about you, such as your display name and your in-game activity. Only invite and play with people you trust.
4. Voice Chat
When you join a voice-enabled game room, your microphone audio is shared in real time with the other players in that room. By joining, you consent to having your voice transmitted to those participants. You are solely responsible for ensuring that participating in voice chat is lawful in your jurisdiction and for what you choose to say. Treat other players with respect and do not use voice chat to harass or harm others.
5. Acceptable Use
You agree not to use the Service to:
- harass, threaten, bully, or harm other people;
- record or capture other participants without their consent;
- post or transmit content that is illegal, infringing, hateful, or obscene;
- impersonate any person or misrepresent your affiliation with anyone;
- access the Service through automated means or attempt to disrupt or reverse-engineer it; or
- violate any applicable law or the rights of others.
6. User Content
You retain ownership of the content you create or share through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process that content solely as needed to operate and provide the Service. You are responsible for the content you share and confirm that you have the rights to share it.
7. Subscriptions, Billing, and Refunds
Some features may require a paid subscription. Subscriptions are billed through the app store you use and renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your app store account settings. Except where required by law, payments are non-refundable.
8. Intellectual Property
The Service, including its software, games, design, logos, and content we provide, is owned by us and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service for your own personal, non-commercial enjoyment, subject to these Terms.
9. Third-Party Services
The Service relies on and may link to third-party services that we do not control, such as app stores and communications providers. We are not responsible for those services, which are governed by their own terms and privacy policies.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your information. By using the Service, you acknowledge that you have reviewed it.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we need to protect the Service or other users, or as otherwise permitted by law. Provisions that by their nature should survive termination — such as ownership, disclaimers, limitation of liability, and indemnification — will continue to apply.
12. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
13. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the total amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
14. Indemnification
You agree to indemnify, defend, and hold harmless WIENER and its operators from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or the rights of others.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration rather than in court, and you and we waive the right to participate in a class action, to the extent permitted by applicable law. Some jurisdictions do not allow certain of these limitations, in which case they apply only to the extent permitted.
16. Apple and Google App Store Terms
If you download the app from the Apple App Store or Google Play, you acknowledge that these Terms are between you and us, not with Apple or Google. Apple and Google are not responsible for the app or its content, and the applicable app store terms also apply to your use of the app.
17. Changes and Contact
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and your continued use of the Service means you accept the revised Terms. If you have any questions, contact us at hello@wiener.wtf.
